Frequently Asked Questions About Stormwater Maintenance Compliance

The EPA’s primary role under the Clean Water Act is to protect the nation’s water supply. It does so by regulating discharges of pollutants into U.S. waters and by establishing water quality standards for surface waters.

The CWA empowers the EPA to implement pollution control programs related to stormwater management, including setting requirements for stormwater management in various settings such as communities, developments, businesses, and residential areas. It also sets water quality standards for all contaminants in surface waters.

Urbanization leads to the loss of infiltration from natural landscapes like forests, wetlands, and grasslands. Impervious surfaces like roads and rooftops prevent rainwater from infiltrating into the ground, resulting in rapid runoff with higher water temperatures that can harm aquatic life and cause sediment loads.

NPDES, established under the federal Clean Water Act, regulates pollution by controlling sources that discharge pollutants into U.S. waters. Municipalities must apply for NPDES permit coverage to operate storm sewer systems and are required to develop and implement stormwater management programs to protect water quality.

The six minimum control measures for stormwater management programs include Public Education and Outreach, Public Participation/Involvement, Illicit Discharge Detection and Elimination, Construction Site Runoff Control, Post-Construction Runoff Control, and Pollution Prevention/Good Housekeeping.

Post-construction stormwater management sets standards for property owners to adhere to once construction is complete. It includes strategies that prevent or minimize water quality impacts, the use of ordinances to address post-construction runoff, and ensuring adequate long-term operation and maintenance of BMPs.

Landowners, both commercial and residential, are responsible for managing runoff from their properties. This includes developing and implementing a stormwater pollution prevention plan (SWPPP) that addresses site assessment, erosion and sediment control, good housekeeping, post-construction measures, and operations and maintenance.

Structural BMPs include detention systems like StormCapture®, biofiltration systems like BioPodTM, media filtration systems like PerkFilter®, and infiltration systems such as MaxWell® drywells. Landowners are encouraged to ensure the appropriate implementation and maintenance of these BMPs.

Landowners can avoid fines by adhering to the post-construction criteria set forth in the SWPPP and understanding local, state, and federal stormwater regulations. Oldcastle Infrastructure’s maintenance solutions can help you stay compliant.

Many Phase I & Phase II cities require stormwater utility fees based on impervious surfaces to fund their stormwater programs. Property owners may also be required to install stormwater management facilities on site to mitigate post-construction runoff.

The EPA can take civil and criminal actions against parties in violation of the Clean Water Act. It can also act in place of state or local governments not enforcing environmental regulations.
